Re-Introducing Cool Kitten Auctions

I got inspired to get crafty when Hurrican Ike hit. There was no TV, No Internet, No Playstation, No air conditioning; but there was plenty of water for bathing and cooking, a nice BBQ grill outside, and our refrigerator acted as a ice-chest for the 2 1/2 days we were without power. I got back to beadwork because I couldn't sleep in the heat, and to keep from killing relatives. I like the inspiration that I get from ancient egyptian and african pattern, modern designs and shapes. Right now, design is very simple and rudimentary, but I find it very beautiful.

Oh, my lord, I do love this wool coat!  I got it off of QVC the other week and it is just the perfect blend of warm and dressy.  I take the faux fur collar when I'm dressing ordinary, but put it back on with business suits and dresses.  I love it, love it, love it!  I bought the black one, because one can never have too much black in their wardrobe.

U.S. GOVERNMENT ANTI-COUNTERFEITING STATUTE


18 USCS § 2320.

§2320. Trafficking in counterfeit goods or services

(a) Whoever intentionally traffics or attempts to traffic in goods or services and knowingly uses a counterfeit mark on or in connection with such goods or services shall, if an  individual, be fined not more than $250,000 or imprisoned not more than five years, or both, and, if a person other than an individual, be fined not more than $1,000,000.  In the case of an offense by a person under this section that occurs after that person is convicted of another offense under this section, the person convicted, if an individual, shall be fined not more than $1,000,000 or imprisoned not more than fifteen years, or both, and if other than an individual, shall be fined not more than $5,000,000.
(b) Upon a determination by a preponderance of the evidence that any articles in the possession of a defendant in a prosecution under this section bear counterfeit marks, the United States may obtain an order for the destruction of such articles.
(c) All defenses, affirmative defenses, and limitations on remedies that would be applicable in an action under the Lanham Act shall be applicable in a prosecution under this section.  In a prosecution under this section, the defendant shall have the burden of proof, by a preponderance of the evidence, of any such affirmative defense.
(d) For the purposes of this section--
  (1) the term "counterfeit mark" means--

  • (A) spurious mark--
  •   (i) that is used in connection with trafficking in goods or services;
  •   (ii) that is identical with, or substantially indistinguishable from, a mark registered for those goods or services on the principal register in the United States Patent and Trademark Office and in use, whether or not the defendant knew such mark was so registered; and
  •   (iii) the use of which is likely to cause confusion, to cause mistake, or to deceive; or
  • (B) a spurious designation that is identical with, or substantially indistinguishable from, a designation as to which the remedies of the Lanham Act are made available by reason of section 110 of the Olympic Charter Act;
but such term does not include any mark or designation used in connection with goods or services of which the manufacturer or producer was, at the time of the manufacture or production in question authorized to use the mark or designation for the type of goods or services so manufactured or produced, by the holder of the right to use such mark or designation;
(2) the term "traffic" means transport, transfer, or otherwise dispose of, to another, as consideration for anything of value, or make or obtain control of with intent so to transport, transfer, or dispose of;
(3) the term "Lanham Act" means the Act entitled "An Act to provide for the registration and protection of trademarks used in commerce, to carry, out the provisions of international conventions, and for other purposes", approved July 5, 1946 (15 U.S.C. 1051 et seq.); and
(4) the term "Olympic Charter Act" means the Act entitled "An Act to incorporate the United States Olympic Association", approved September 21, 1950 (36 U.S.C. 371 et seq.).

Why You Should Never "Re-gift"

I have been doing a lot of cleaning up lately and I came across this pretty wooden box that a former cowoker, Sherry Knigge, gave to me 3 years ago:

Per the information book it is made out of linden wood from the Tatra Mountain region of Poland. It has a wonderful smell on the inside:

When I firrst got this present, 3 years ago, I was overjoyed because it was beautiful. Then I looked at the bottom of the box:

The inscription on the bottom says:
For Sherry--Christmas 2001. In Lasting Friendship. -- Judi

I'm not appalled that she "re-gifted." I was appalled at how obvious it was that she did! And then I felt disgusted because she obviously didn't read the bottom of this wooden keepsake box. It just didn't seem like Sherry held this person in high regard if she is giving away her gifts. So, I'm posting it for sale on my selling journal as a nick nack. I don't need it and I'm moving anyway.......

Good Morning !

I hope that everyone had a great New Year and isn't too hung over today.  Morning seems to be the best time for my concentration lately and I just wanted to share two sites that I found interesting.

The first is You Sell it For Freehttp://www.usellit4free.com/cgi-bin/aboutus.pl   This is a very interesting concept.  Essentially, they only charge for successful completed auctions.  This is something I may consider using in the future. 

The second is ScamChecker, and anti-fraud website that checks an e-mail or phone number against a database to see if they have been reported for online scamming.  This is good and bad.  What is good is that this data is being collected and reported.  What is bad is that the people doing the reporting are our fellow online shoppers/consumers.  I would take this one with a grain of salt and still be normally vigilant during all of my online transactions.  They can be checked out here:  http://www.scamchecker.com/index.html   and here:               http://www.scamchecker.com/about.html
